Terms of Use

1. Who we are

SurgNet is operated by SURGNET PTY LTD (ACN 699 914 924), an Australian company ("SurgNet", "we", "us"). You can contact us at info@surgnet.com.au.

2. Acceptance of these terms

By creating an account, or by using the SurgNet platform, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the platform. When you create an account you are asked to confirm your agreement expressly.

3. Who can use SurgNet

SurgNet is for medical practitioners: surgeons seeking surgical assistants, qualified surgical assistants, and administrative staff expressly authorised by a surgeon to act on their behalf. You must:

  • hold a current AHPRA registration (for clinical roles) and provide your registration number accurately;
  • provide true, current and complete information, and keep it up to date; and
  • be qualified for the role you select.

New accounts are checked against the public AHPRA register before they can participate. This verification confirms only that a registration exists and is current. SurgNet is not endorsed, approved or accredited by AHPRA, the Royal Australasian College of Surgeons, or any other registration body or college, and verification on SurgNet does not represent any such endorsement.

4. Your account

You are responsible for all activity under your account and for keeping your login credentials secure. Do not share your account, and do not impersonate any other person. Tell us promptly at info@surgnet.com.au if you believe your account has been compromised.

A surgeon may invite specific administrative ("rooms") staff to act on their behalf within the platform. The surgeon is responsible for the actions their delegate takes through that delegation, and may revoke it at any time. Every delegated action is recorded against the individual who performed it.

5. What SurgNet is, and is not

SurgNet is a coordination and matching platform: it lets surgeons post the logistics of an operating list, and lets verified assistants find and apply for that work. SurgNet:

  • is not a party to any arrangement between a surgeon and an assistant;
  • is not an employer, employment agent, locum agency or workforce supplier;
  • does not provide clinical, medico-legal, billing, insurance, tax, employment or legal advice;
  • is not a medical record, a clinical system, or a hospital system of record; and
  • does not verify hospital credentialing, scope of practice, or indemnity insurance.

Decisions about who to work with, the terms of that work, fees, billing (including informed financial consent), hospital credentialing and insurance are entirely between you and the other member, and remain your professional responsibility.

6. No patient information

You must not enter patient information anywhere on SurgNet. This includes patient names or initials, unit record or medical record numbers (URN/MRN), dates of birth, Medicare or health identifier numbers, addresses, images, or clinical details that could identify a patient.

Free-text fields such as the procedures and notes on an operating list are for describing the work and its logistics only, for example "3x laparoscopic cholecystectomy, 1x hernia repair". They are not a clinical handover and must never contain patient-identifying information.

If we become aware of patient information on the platform we may remove or edit the content, and repeated or serious breaches of this clause may lead to suspension or termination of your account. If you notice patient information on the platform, report it to info@surgnet.com.au and we will act on it promptly.

7. Acceptable use

  • Use SurgNet lawfully, professionally and only for its intended purpose.
  • Do not post false, misleading, defamatory or confidential information.
  • Only post operating lists that are genuine and that you (or the surgeon you act for) intend to staff.
  • Use other members' contact details only to coordinate the work at hand, never for marketing or any unrelated purpose.
  • Do not attempt to probe, disrupt or gain unauthorised access to the platform or other members' data.
  • Do not scrape, harvest or bulk-export platform content or member details.

8. Notifications

SurgNet sends service notifications (for example new applicants, application outcomes, and reminders) in-app and, depending on your settings and role, by email, SMS and push notification. These are part of how the service works. You can manage notification channels in your profile settings.

9. Fees

SurgNet is currently free to use. If we introduce fees or paid plans in future, we will give you clear notice first, and continued use of a paid feature after that notice will be your agreement to the applicable fees. We will never charge you retrospectively.

10. Content and intellectual property

You retain ownership of the information you post, and you grant us the licence needed to host, display and transmit it so the platform can operate. The SurgNet platform, name, logo and software remain our property. You may not copy, modify or reverse engineer the platform.

11. Suspension and termination

You can stop using SurgNet at any time and can ask us to delete your account by emailing info@surgnet.com.au. We may suspend or terminate an account that breaches these terms, poses a security risk, or is used unlawfully. Where practical we will tell you why and give you a chance to respond.

12. Availability and changes to the platform

SurgNet is in active development. Features may change, be added or be withdrawn, and the service may occasionally be unavailable, for example during maintenance. We do not guarantee uninterrupted or error-free operation, and you should not rely on SurgNet as your only channel for arranging surgical assistance for a critical list.

13. Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other right that cannot lawfully be excluded.

Subject to that, SurgNet is provided "as is", and to the extent permitted by law we exclude liability for loss arising from your use of (or inability to use) the platform, from arrangements made between members, or from the acts or omissions of other members. Where liability cannot be excluded but can be limited, our liability is limited to resupplying the service.

14. Governing law

These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.

15. Changes to these terms

We may update these terms as SurgNet develops. For material changes we will notify account holders (in-app or by email) before the change takes effect. The current version, with its "last updated" date, is always published on this page. Continued use after a change takes effect is acceptance of the updated terms.
